Phillips, Chief Judge. George Dickstein, owner of U.S. Patent No. 3,711,864, and Sports Products Corporation, of which Dickstein is president, brought this action for infringement against Seventy Corporation, Grantham, Inc., and Peter Boyko. The District Court rejected the defendants' counterclaim for declaratory judgment of invalidity and held the patent valid and infringed. We reverse the finding of validity and therefore do not reach the issue of infringement.
