On receipt and consideration of a petition for rehearing filed by the Secretary of Health, Education and Welfare; and Noting petitioner's position ""that this court should have considered the Part B claim under the previous law, without reference to the 1978 Amendments""; and believing, on the contrary, that Congress in the 1978 Amendments was again telling the Secretary that he had interpreted the Black Lung Act too narrowly and that this court has both a right and duty to consider the 1978 enactments, Said petition for rehearing is hereby denied.
