1. Counties ? Delegation of authority ? Discretionary power. Generally, the right of the county board to delegate its authority depends on the nature of the duty to be performed, and powers involving the exercise of judgment and discretion are in the nature of a public trust and cannot be delegated to a committee or agent. 2. Agriculture ? County fair commission could not delegate discretionary powers. The county fair commission was not authorized to delegate discretionary powers conferred upon it by statute to advertise resources and advantages of the county, to state chamber of commerce by turning the amount appropriated out of the general fund of the county for advertising over to the chamber of commerce. 3. Constitutional law ? Determination of constitutional questions. The constitutionality of a statute will not be determined unless a determination is absolutely necessary to a decision upon the merits.
